Erode: The Madras High Court has quashed the order issued to remove the seal placed on the Erode Erode & Salem Sudha Hospital, Perundurai Ram Prasad Hospital in connection with the sale of eggs. The registration of a private hospitals Erode & Salem Sudha Hospital, Perundurai Ram Prasad Hospital in Erode has been suspended and scan centers have been ‘sealed’ in connection with the sale of eggs from a 16-year-old girl in Erode.
Hearing the case filed by the private hospital against this, the Madras High Court granted time to the hospital to explain and canceled the orders of the Tamil Nadu government stating that the registration of the hospital can be suspended only if it is satisfied that there is a violation and the reasons for suspending the registration were not given.
The High Court also ordered the hospital to issue a final order within 12 weeks after giving time to explain, and removed the seal placed on the hospital. An appeal has been filed by the Director of Medical and Rural Health Services of Tamil Nadu against this order.
When the appeal case came up for hearing before the bench of Chief Justice Muneeshwarnath Bhandari and Justice Bharata Chakraborty, Additional Chief Public Prosecutor Ravindran said that there is room in the law to seal the violating hospital in the interest of public interest and there is no need to send advance notice. He argued that 3 people have been arrested.
While the hospital has been functioning for the past 35 years without any complaints, the hospital management argued that this action was taken based on press reports and that they should state the reasons for suspending the registration even though they do not have to ask for an explanation as per law.
The judges, after hearing arguments from both sides, said that since the government’s order has been issued stating that the registration of the hospital is being suspended in the public interest due to violation of the rules, it cannot be said that the reasons were not given.
